Sales terms and conditions

Please, read carefully the following conditions

Bookings placed form a contractual agreement between you as customer, and myself, Jean-Guy Le Roux, touristic intermediary (under licence nº I-003115.1), trading as GuiaNatura EcoTourism. By placing a booking you are indicating your acceptance of the following sales terms and conditions. And where you are placing a booking on behalf of other people or other group members you are also indicating your group’s acceptance to them as well.

 

  1. Unless otherwise stated all bookings are placed on a private booking basis, for a particular activity (birdwatching, stargazing, walking or any other) and are for a pre-agreed number of participants and for a pre-agreed fee.

 

  1. Your tour will be accompanied by a guide who will meet you at a pre-arranged location and travel with you to the start point of the activity. Your guide will speak English, hold a current first aid qualification and possess the necessary skills to lead your activity with reasonable skill and care.

 

  1. I accept no liability for accident or personal injury except where caused by my own negligence.

 

  1. I accept no liability for any loss or damage to your personal property how so ever caused.

 

  1. I accept no liability for any consequential loss or injury incurred by your participation or no participation in any of the activities you book, except as stated in paragraph (3). (For example, if you book an activity and have a flight or ferry to meet just after and we fail to reach your destination in time, I am not liable for your out of pocket expenses.)

 

  1. It is your responsibility to ensure you have the required fitness to complete the activity you have booked.

 

  1. It is your responsibility to ensure you have all the items listed in the equipment list prior to departing on the trip. If you present yourself without the correct equipment, I or your guide, reserve the right to refuse to take you on the activity and no refunds will be offered.

 

  1. It is your responsibility to ensure you have adequate mountain rescue, medical and repatriation insurance.

 

  1. You must follow all safety instructions given to you by myself or your guide while participating in the activity. Failure to follow safety instructions will result in your trip being terminated and no refunds offered.

 

  1. You must take care not to put yourself or other people at risk while participating in the activity.

 

  1. You must take care not to damage the natural environment while participating in the activity and should obey any directions given you by myself or your guide in this respect.

 

  1. Failure to comply with the responsibilities listed in paragraphs (6) - (11) shall be considered grounds for termination or curtailment of your trip and no refunds will be offered.

 

  1. Duration. I aim to deliver an activity of some hours to a full day of duration, including breaks for food. However, if conditions or your physical fitness mean we are unable to complete the desired activity within the established time frame, I (or your guide) reserve the right to curtail the activity, including to extend the activity (with you agreement) at your expense according to the established rates.

 

  1. The activity. I guarantee you a particular activity, not a particular route or destination. Outdoor activities are such that weather conditions, accidents, route closures and other incidents outside my control can interfere with objectives like reaching a particular place, or walking a particular route. With this in mind if your original intentions are untenable, an alternative route or destination will be offered instead. No refunds will be offered should we be unable follow your desired route or reach your desired destination and no refunds will be offered if you refuse the alternative offered.

 

  1. Payment. A full payment in advance will be required to reserve your trip. This can be made by:
  • PayPal account;
  • Bank account transfer;
  • Secure payment by PayPal (+5% charge for PayPal outgoing).

 

  1. Booking is confirmed once received the income on my account.

 

  1. If I cancel your booking I will offer you a full refund of any monies paid by the same mean of payment you used.

 

  1. Cancellation of programme of more than one day for travel agency. If you cancel the booking:
  • for cancellation up to 15 days before the service, the refund of the amount will be 100% (minus management fees of 10€),
  • for cancellation between 14 to 8 days before the service, the refund of the amount will be 100% (minus opportunity costs of 130€ per day),
  • for cancellation between 7 days and 48 hours before the excursion, the refund will be 50% of the amount paid (with a minimum of 250€ per day),
  • in case of cancellation in the last 48 hours or if the client do not show up, the paid amount is forfeit and no amount will be returned.

 

  1. Cancellation of one activity with guide. If you cancel the booking:
  • for cancellation up to 15 days before the service, the refund of the amount will be 100% (minus management fees of 10€),
  • for cancellation between 14 to 8 days before the service, the refund of the amount will be 75% of the amount paid,
  • for cancellation between 7 days and 48 hours before the excursion, the refund will be 50% of the amount paid (with a minimum of 130€),
  • in case of cancellation in the last 48 hours or if you do not show up, the paid amount is forfeit and no amount will be returned.

 

  1. Cancellation of an activity without guide. If you cancel the booking:
  • up to 48 hours before the service, the refund of the amount will be 100% (minus management fees of 10€),
  • from 48 hours till 24 hours before the day of the excursion, the refund of the amount will be 50% of the amount paid,
  • passed 24 hours before the excursion, the paid amount is forfeit and no amount will be returned.

 

  1. Cancellation of Hike to Teide peak. You are doing an activity which is strictly limited in number and with permit of the Teide National Park, so we want to be sure that permits are available for people that really do the activity. If you cancel the booking:
  • up to 15 days before the service, you will get your money back (minus management fees of 10€),
  • from 14 days to 7 days before the service, the refund will be 50% of the amount paid,
  • from 6 days before till the day of the service, the paid amount is forfeit and no amount will be returned.

 

  1. Rescheduling. If you decide to reschedule your activity, I will, subject to availability, accommodate one change to your booking date, I will where possible transfer any advance payments onto this new date to avoid the need for you to pay twice. However, if as part of your activity we have contracted 3rd party services, including but not limited to, a minibus, a boat-taxi etc, then the money paid towards these 3rd party services will be subject to the refund policies of the 3rd party entity.

 

  1. Force Majeure : from time to time bad weather, route closures, labour dispute, access restrictions and other incidents outside my control could interfere with your trip. In the first instance I will always try to offer you an alternative route, as detailed in paragraph (14), which you are obliged to accept or forfeit any monies paid. Where this is not possible (ie: where it would be dangerous to go out anywhere), or at my discretion, I will attempt to schedule your activity to a mutually convenient future date, or offer you a full refund of any monies paid.

 

  1. Teide cable car. In case that the cable car is closed for meteorological reasons or some other reason, the guide will offer you an alternative path for a visit of 3 hours.

 

  1. Any disputes arising from this agreement shall be subject to the jurisdiction of the Courts of Arona, Tenerife.
